You are correct: states have governmental *powers* not rights; they are not a person. They have whatever powers are allowed to government under the Constitution and not reserved to the Feds. Common usage, which as you point is is incorrect, is to use the term "states' rights" as shorthand for those powers available to the state.
I also, as noted, think the bill that went to Jerry steps into reserved ground, which will probably result in some interesting court cases if it's signed. I filed a comment. If anybody else wants to, the clock's ticking - since the legislative session ended on Sunday there are only a couple of weeks available for Jerry to make sign-or-veto decisions. The cynics among us will say that nobody looks at those things. May be true in general, given the quantity of drivel that politics tends to generate, but there's always a chance that a well-written comment will get through at least to somebody on Jerry's staff who can read. It's still your government, even if your taxes only buy you a very tiny piece of it.
