There was some discussion that this somehow oversteps local authority and somehow "regulates" interstate commerce, by the constitutional scholars on this thread, it doesn't. It is a health and safety measure, and in one of my career iterations, I've been involved in taking millions in fines out of the SP for visibly smoking engines violating state health and safety laws protecting your "local" lungs from damage.
I expect that this will end up with a new data base for local responders to more effectively identify these loads, although I also agree this is mostly just "feel good" legislation to reassure the public.
The specification of Bakken per se, wouldn't cover Monterey Shale fracking oil, and doesn't make much sense (if true?). The oils released from deep fracking are generally much more fluid, gaseous, and volatile, making then super "sweet" crude, giving us more cheaper gasoline per barrel, but also making it more "explosive".
