Bleating and posturing aside, this new law is probably well within the State's purview on issues of health and safety.
It will be interesting to hear the RR's basis for this suit. But based on a lot of other health and safety related laws, this particular issue may not be the most effective one to try out Federal "pre-emption" on? Since this is just not that onerous a requirement, and there is a clear nexus to State health and safety authority, long recognized by RR's and Courts.
Aside from the usual bleating, about the usual evil jack booted thugs, and the predictable drivel about how much "Kalifornia" sucks, how many of you really don't want RR's to be required have effective response plans, which are coordinated with local authorities, in place for when oil trains do crash, which this law calls for?
