Perhaps the solution is to require shippers who ship these materials protect the RR before the shipment is accepted. It seems that the RR should be responsible for the damage done in the derailment and the shipper for the excess caused by the explosion or fire or etc. resulting because of the material being shipped which would not be normally casued by a derailment.

Of course they will never allow that amount of explosive materials to be trucked, and we will not allow new pipelines, so the solution above seems reasonable.
