IIRC, SMART DMUs are fully compliant with "old school" FRA crashworthiness requirements, in addition to having CEM features ("crush zones"). They did not request or need a waiver.

eBART, using Stadler GTWs is not compliant with the "old school" requirements. I do not recall that they were going to be sharing tracks with other trains, anyway, so no compliance with old school requirements is necessary.
