You're right of course, but....
this is the Internet Age. "Everyone" knows that if it is on the web, it is "free".
There was a case where a woman was republishing doll clothing patterns as her own; her excuse was she found them on the net and therefore she could claim them. Ultimately, she lost in court and her magazine was forced to close.
