This sounds vaguely like it's a the PUC sort of thing, which not being a trainman I've heard about but am not all that familiar with.
As explained to me a long time ago by an SP special agent, they (RR cops) were sort of in between citzens and regular "police", at least in California. They didn't quite have the same powers of arrest that the regular cops did because the Legislature wanted to avoid private police forces, which are a power of government (and should stay that way). Think of the tons-tons macoutes.
On another note, if the "conductor" is merely a ticket-taker, then he/she/it isn't under HOS. OTOH the engineer (motorman, driver, whatever) is. If that "condcutor" participates in the operation of the train (throws swithces, takes main track authority from the DS -like authority to pass a signal is stop position- etc.) then he/she/it is uner HOS. As far as crossover between the two crafts, most of what I've seen here and in that "highly accurate and reliable" newspaper article is speculation.
