It is all complicated. The number of positive random tests dictate the percentage of employees to be tested. If the positive rate for drugs or alcohol stays below .01 percent of the tests, the railroad is obligated to test 10% of the covered workforce for alcohol and 25% of the covered workforce for drugs. Carriers can and do test a larger percentage of the population.
FRA has been conducting post-accident tests of the fatal remains of employees checking for more drugs than the 5 currently specified by HHS (FRA is permitted to do this). The agency reports evidence of a lot more drug uses and more than one drug in their systems.
