If IPH bails out the county will assume the common carrier responsibility of a shortline railroad whether they like it or not. Until the STB approves an abandonment (which in most cases can't be started until 2 years after the last revenue load is interchanged to the UP) it is still a viable railroad and part of the National Rail Transportation System and must be treated as such.

UP would most likely have to assume service under a "designated operator" scenario.
