It seems to me, a non lawyer that although the contract says UP and it's successors retains rights to freight service forever, but if there are no shippers on the line between the end at the old cement plant in Davenport and the point in Watsonville where UP is still operating then isn't it all a moot point?
I'm not familiar with the area but it seems like it's mostly rural in the Santa Cruz area and probably not zoned for manufacturers big enough to build new plants near the tracks that would need rail service.
I assume that any attempts to put industries out there that would increase traffic and noise would be opposed by NIMBY'S at planning commission and other agencies that issue building permits.
I think you said a long time ago that there were some potential new freight customers in the Watsonville area but are there any potential clients in the Santa Cruz area?
Would UP keep the line just for freight car storage?
