Since local police don't enforce federal law there would be no basis for such a charge. Local police could have arrested him for some very minor misdemeanor (ie disturbing the peace) and issued him a citation. And don't forget.....almost never do violations of federal law result in federal prosecution. (Especially in the Northern District of California.) Just the facts of life.
