While the choice of union (or none) will most likely be decided by the operator...if it's considered a "part of the national rail (freight-Amtrak) system, the FRA will insist on certified locomotive engineers.

While my expertise is not in this area, I do know that Portland's new Westside Commuter Rail which is set to open this fall is a part of the TRI-MET light rail system but because it operates on the Portland & Western it will be operated by the P&W crews because of certification and union requirements. Because of the higher speed operations anticipated, locomotives have been equiupped with cab signals and the grade crossing control systems have been upgraded with new more sophisticated equipment in order to conform.
