In these type of transactions normally all liabilities and existing contracts are moved to the surviving company. So I wonder what the buy out will be for NWP or if SMART is able to buy them out.

Alson not talked about is the legal presidence of the easments reverting to the land owners if they are used for anything but rail. Federal law has returned land to owners if the railroad is removed, how will that work for a train. This could be tied up on court for years.
