Mitch claims the freight trains will be rolling in Spring '09.

Here's the judge's ruling


THIS CASE HAS BEEN DISMISSED PER THE PARTIES’ CONSENT DECREE.
THE COURT HAS AGREED THAT THE SETTLEMENT AND DISMISSAL IS
APPROPRIATE, RECOGNIZING THAT THE PARTIES’ AGREEMENT PROVIDES
FOR CEQA COMPLIANCE AND THAT THE PARTIES HAVE AGREED TO THE
COURT’S RETENTION OF JURISDICTION, PURSUANT TO CCP §664.6. THE
COURT HAS DISSOLVED THE PRELIMINARY INJUNCTION PURSUANT TO THE
CONSENT DECREE.
