In the case of the UP, shareholders are preferred over safety. Often when a contractor is working along the right of way, UP doesn’t want to pay a Forman to supervise and only a Form C will be issued in the orders for trains saying something to the effect of, “Contractors working along the right of way between xxx and xxx. Use plenty of bell and whistle.”
No requirement to slow or contact anyone, but since there is a warning, they can still try to blame the train crew if the poo hits the fan, such as this incident.
