I alluded to this happening several weeks ago and the usual trolls and NWP haters through cold water on it. American Indians have filled with the STB for a OFA (Offer of Final Assistance) to rebuild and reopen the embargoed Northwestern Pacific to ship Coal from the Rockies thru the Port of Eureka to the Far East. The Crow and Navajo tribes are behind this as the domestic coal industry has flat lined and they are siting on millions of tons of coal and not place to ship it to make money. Believe me this is a very well though out plan to partner with the moribund Port of Eureka and an active railroad. Be sure to read the Official STB finds at the end of the story. There is going be law suits and the like to stop this but the Indians hold all of the cards, plus they have their sovereignty status usurping many arguments put up by City, County and State laws. The Coal is NOT being burned here so no green house gases involved and the loads will be sealed so NO coal dust. STB will always rule in favor of an OFA so its a matter of time before they put a shovel into the ground. UP and BSF will gladly forward the coal to the NWP and make good money from it. The permitting process does not necessarily apply here because they are buying an existing railroad which in itself allows for reconstruction. You will see in the filling that they have case (law) study on their side and STB must follow it in prior decisions they have made. Yes the fur will fly but the Indians just like casinos have the law on their side.The coal will come from several tribes in Montana, New Mexico and Azizona.
