Yep...
And, there was no legislation that allowed the funding of public private rail passenger services in the United States of America until it passed in 2022.
So unless this always somewhat dubious and desperate seeming alternative service were still in business, had the UP's permission to operate over their tracks, had an eligible cost effective project, and actually had applied for funding, then nobody has discrimated against anybody.
