FRA emergency order # 21 is what must be completed before FRA will allow the operator to again run trains. the EO covered track, Signal, bridge and crossing signal and mechanical conditions, plus employee qualifications and training.
I do not think the FRA region or DC will allow the NCRA or the operator to begin operations on FRA excepted track, 49 CFR part 213.4 not after the history of past operators and the NCRA itself and thier failure to use good oversight of the previous operators. After spending over 30 million dollars of our money the line had better be in at minimum of FRA class 1 (one).
If they do not have all the items in EO 21 and all the inspections which led up to EO 21 they will not remove EO 21 and not allow operations
