I'm not so sure they are illegal! Generally, devices that don't propagate a radio signal more than about 150ft are unregulated in an industrial environment - and only modestly regulated elsewhere. And I would think that railroad trains must certainly be considered an industrial environment. So what if there just happens to be interference with a cell phone control signal - causing dropped calls.

....It becomes: Let's you and I make a deal - you don't talk so loud and I won't broadcast my interfering device so loud - WIN WIN !


But who cares anyway!

Also against the rules, are talking loudly, disturbing other passengers in any way, interfering with operations, or interfering with employees in any way. Amtrak, as do all other transport agencies, reserves the right to put anyone off for disobeying those rules - at the sole discretion of the conductor. Read the disclaimers that comes with your ticket. She agreed to all of those rule when she bought the ticket, and became legally bound when she gave consideration (paid for the ticket).

But most trains have enough ambient noise already, that someone talking normally (even on a phone) won't bother anyone. She had to be shouting! And continued shouting is almost everywhere legally considered disturbing the peace! And if you need to shout into the thing - it's a crappy phone anyway. As for boom boxes, and anyone who threatens violence (even if just by glowering into your face) has legally committed assault and should be summarily put off the train, arrested and charged.

Amtrak Done Good! They were within their rights - and conceivably could be sued if they didn't do something. It is unlikely she will get anywhere with any competent lawyer - especially if she has been charged with disturbing the peace - which she should have been.

As to Race - again Who Cares!

AS to her feeling disrespected - GOOD! She did not earn any respect! She should be disrespected - just as she was disrespecting everybody else.

She is only feeling her own Karma coming back to haunt her!
