I believe the reason that an EIR was done is due to the Federal money being used for the project, and they require an environmental impact report as condition of funding. I believe that NCRA also rec'd Federal monies for part of the work they did so they needed to complete the EIR.

Normally, a RR is not regulated by local citys or agencys within their own right of way and does not need to file for permission to complete work. I also remember that the right of way is 12-15 feet from the nearest rail.

Once you complete the document and certify it, you leave yourself open for everyone to take pot shots, so why would anyone want to do that.

Please correct me if I am not correct.
