The NWP railroad has been plagued by threats of lawsuits. No rational shipper would invest in infrastructure to enable rail shipments until they were sure that the railroad was going to be operational for a period of time suitable to recover their investment. The lawsuits establish a real risk that the railroad could be closed, or subjected to interruption by a sympathetic judge.

The railroad is operational now, which lowers the risk. But some shippers aren't going to make the investment until they have confidence that the railroad will be operational for much longer than a few months.

It is sad that the fake environmentalists are trying to stifle the rail freight economy and the associated extra jobs that would be created.
