I'm not sure what would happen if the courts or STB rules that railroads must haul TIH without a working PTC system after 2015. From a legal standpoint, can a railroad be compelled to violate one federal law to be able to fulfill another?

I agree that railroads have a common carrier obligation, but at present this is a no win situation for the TIH producers, passenger operators and the railroads. This is going to be a horrific mess unless either Congress acts to extend the deadline or a Federal Court issues a stay against the PTC requirement.

Stay tuned, the next two months are going to be interesting.
