Just had a crazy thought: if the RRs just shut down completely, could they lease lines to the chemical companies, and let the chemical folks run private operations to supply distribution centers and large users? Wouldn't be offering service as a common carrier; if RRs are involved in operation at all (Herzog?) it would be as a contract operator for the chemical company. Would the PTC deadline apply to non-common carriers? Probably, but it's an interesting thought experiment.
