What the state giveth, the state can taketh away.
NCRA is a creation of the state.
NWP Co. is the private freight operator with a lease
to operate freight on publicly owned row. Yes, the FRA has oversight of the
freight operations on the track owned by the NCRA,
including whether the saftey regulations are met. However,
in this case, while the FRA can keep the freight from
operating, it can't guarantee that it will operate.
As an example, the EIR requirements for the NCRA are
emanating from state law. Whether the NCRA will have
to complete a federal EIS has not yet been fully determined.
