The shippers and railroads will fight this for the exact reason you mentioned. Once the dust settles in a few years I expect there will be no fee but instead the railroads, shippers, trucker will be required to donate to the fund. Not a horrible concept on paper. But whats to keep the state from dipping in the till and using the money elsewhere???
