So if the trains blow their horns, it's the railroad's fault for shattering everyone's peace and quiet. If they don't and a driver or pedestrian is hit anywhere along the right of way, it's the railroad's fault for being negligent. If SMART were to give up the entire operation, they'd be faulted for wasting millions on a complete boondoggle. If they begin operations and the daily traffic jams on Highway 101 don't go away, it's the railroad's fault for not easing the strain of the commute. If the entire railroad were somehow relocated to open country and miles away from existing homes, it would be at fault for trashing the environment and not providing service to populated areas. If anyone were to invent completely noise free trains, then SMART would somehow be liable for loss of productivity resulting from commuters delayed at grade crossings. No one ever said that outsmarting a NIMBY was easy, after all . . .
