I'm not an expert on abandonments but I don't think the CORP embargo was illegal. Their engineers report on the condition of the tunnels was in line with what the FRA's conclusion was. CORP simply took the safe route and stopped subjecting thir crews to the dangers assocated with the possible "catastrophic collapse" of a tunnel as cited in the FRA report.
