The original post creates many questions. While primarily what I guess the OP would consider a "recreational railroad" (a museum with a tourist line hauling passengers just wanting to go for a ride) TVRM also has a common carrier subsidiary separate from the museum operations under which it operates revenue freight service in multiple locations around Chattanooga, TN on any given weekday.

What the OP describes in their first post sounds more like an industrial switching operation to me. That does not require common carrier authority and is not regulated by the FRA. Those fall under OSHA regulations and are pretty wide open. As long as the operator has a locomotive and people who can run it they've pretty much met the rail qualifications for industrial switching.
