What taxpayer lawsuit? This man has no authority to claim he represents taxpayers. He was not elected, nor was he appointed. He represents himself only.

All special districts with their own governing board or council are in the technical realm as general law municipalities in California; as they generally fall under the same governing provisions. As I understand it, a JBP is one step removed, being subsidiary to multiple other municipalities or counties, as defined by their chartering legislation.

If that same chartering legislation gave the JPB its own taxation authority, then along with it came the authority to put that tax to its constituent voters as required by law. Since it was the JPB that put it to the voters, then 2/3 of those JPB voters must pass it. It's just that simple. Only flimflam men, shysters, and other dishonest johns could make it complicated. Besides that, they already have authority to build a transit system without further votes; with or without the tax, or the tax vote. Of course, some other funding method would be needed.

Moreover, the whole idea that any sub-area of a jurisdiction can thwart the majority in the whole jurisdiction is patently absurd. This was a confederate notion that went out the window, the minute Abe Lincoln shot back at the first bunch to try it; as have numerous presidents sent troops since, whenever a local area tried to thwart Federal Law. It's just too damn bad if Marin doesn't like it. The whole of the legally defined region voted for it, by well over the required 2/3 vote.

This new lawsuit is just another crude attempt by the same old extremists to use the courts to overrule the majority will. But judging by past comments on other threads, this simple concept apparently needs further explaining - to some. In a representative form of government as in California, the majority will is expressed by a vote in a legislature by representatives, or by direct vote in the case of taxation - But not ever by the courts, nor by extremist enviro-lantes, or by any other self appointed do-gooders.

Those extremists tried to abuse environmental law to stop the repair of the NWP, Now they are trying to abuse prop 13 to a similar end, with SMART - which would now thwart the majority will in that issue as well; which will was expressed in this case by both the legislature, and by direct vote.

Note also, that my use of the word extremist, is here limited to the fact that these people appear not willing to live by majority rule; while they pursue their one sided, single-issue agenda at the expense of all other important considerations.
