Is SMART Preparing to Sue the NCRA?

The SMART Board has called a special meeting on Sept 1 to consider litigation.
It does not say whom they intend to sue.
As far as I know, they only reason they would hold a special meeing is to get Board
approval for filing a legal action against the NCRA. There are no other issues
that would require a special board meeting as they could be handled at the
regular Sept 15th meeting. It's SMART's next move to try to get the NCRA
to sign off on a new Operating Agreement that will keep freight from operating
until after 2014.
It's consistent with Marin Supervisor (and former SMART Chair) Charles McGlashan's
comments at the July 27th BOS meeting and his history of suing anyone
and everyone who gets in his way.
But it's an educated guess. Does anyone know?
