The point you make is a good one, however, at this point I really think the Novato agreement is a political move, as NCRA is not regulated by the city. They are trying to be good citizens and get along with their neighbors. However, if they are put into the position they would start service and move the issue to Federal Court, which will have to instruct Novato that they do not have jurisdiction.
