Exactly.
Similar to a court case, both sides present their case, then a arbitrator from the NMB issues his or her ruling. The entire process can take years and years to run its course. In this case, the employee won. But often the arbitrator upholds the dismissal. In any event, it's never just the union going in and demanding the guy's job back.
It's also important to remember that there were three people on the head end of that train. Why didn't either of the other two take action to stop it?
