If the Spinter is running on the former Santa Fe line, then it's under FRA. The only way it could be under FTA is if its entire physical plant (i.e. all the trackage) is completely isolated from the rest of the US's general system RRs, and the former Santa Fe line is part of the general system (on account of the San Diegans/Surfliners).
If those DMU's aren't "FRA-compliant", as you put it, then there's a waiver of some sort involved.
