Since Alameda County owns the line UP may only get track rights and not be able to prohibit NCRY or other passenger trains from operating in the canyon.
I guess you have to look at the NCRY agreement with Alameda County to figure it out but I assume UP would have to pay Alameda County a lot of money to run its trains so the track and bridges can be properly maintained.
I thought UP only wanted to operate on the old SP line during the week when ACE would be running more trains and would operate freight on its own rails during the weekend. If that's true there wouldn't be a problem for NCRY.
Also this is only a part of a larger proposal to increase ACE trains and I don't know if funding is secured.
It could be subject to environmental review and possible court challenges so things will stay the same for a few years
