UP and Kinder Morgan have had a couple of long running lawsuits going with respect to who pays for 'pipeline protection'. These lawsuits just seem to have been resolved, see the meeting minutes on the ACE website [www.theaceproject.org]

K/M will do their pipeline thing, then LACO Flood control, and finally UP will get to finish the 'diversion' in about a two year period.
