Barry, I do not disagree with you on the EIR however, FEMA granted NCRA at "Categorical Exemption" in granting the funds now being used. They said since all improvements, repairs, etc were within the ROW that and EIR was not reequired. NCRA is doing the EIR to be "good neighbors" so to speak. The Marin Judge is way out of his jurisdiction in this case and while I am not a lawyer, when this case goes upstairs, the TRO will almost assuredly be overturned. My question is, will Novato continue to fight it and waste millions in tax dollars in doing so, just to make a point? Couldn't the money be better spent? I agree with whoever "whistle blower" is in the above thread, if Judy Arnold and others continue this fight, come election time, they may find themselves turned out of office since a majority of folks do not agree with their indefesible position. I think their political futures are at stake.
