The little problem with Mike Pechner's last blog, is that
it is contradicted by the court record.

The track repair project involves a great
deal of potential environmental impacts that are required
to be analyzed under state law. NCRA tried to circumvent
this requirement by issuing a "negative declaration" and
were found that they were likely to be found in violation of
the law by Judge Ritchie. (The word "likely" is here because
these are preliminary rulings and can be changed after the case
is heard in August.)

Documentation of these impacts is provided in Novato's court papers,
(available on Novato's website) something the NCRA has never refuted.
The NCRA only argued the statute of limitations had passed, not
that there weren't significant environmental impacts associated
with the track/bridge/levee repair projects.

Finally, if there weren't potential impacts and violations
of state law the judge wouldn't have issued the TRO.
