I'm confused but I thought that the intercity rail programs of this length were covered under the Federal Amtrak law. The "State", through the governance structure of the Capitol Corridors, has "taken over" Amtrak state corridor services here. Any extensions they would choose to make would be covered by that. The last time I checked, the Federal authority should trump the JPA's lesser State authority, or any supposedly "exclusive" charter to operate that segment in the "Caltrain" charter or granted by state legislation....so what's changed?
And, if they can preempt an intercity service provided by the CCJPA, under Federal law, I guess the proposal for the Coast Daylight would be preempted, as well? So why would that be different?
As with many of our worn out undersized congested corridors, this segment of 101 needs both local and express service. And, there would appear to be nothing that prevent both operators from providing those services over that segment, any more than Coaster or ML could or would have a legal right to "preempt" LOSSAN Amtrak trains from operating over NCTC's or OCTA's tracks.....it's done every day.
