I would caution against overconfidence, both about the election and the lawsuit. Critics keep carping about the cost of SMART, which has produced a very bare-bones plan. The likelihood of collisions and delays to auto traffic at key intersections are real problems that could have been alleviated by grade separation. Downtown San Rafael stands out like a sore thumb. In the real world you get what you pay for.
A collision between a dmu and a truck would not be pretty. I suspect that accidents were one of the reasons the busway conversion idea was discarded a while back.
