You've noticed, perhaps, that places like NY and LA have fences to block off the area between cars? Sometimes on the cars, sometimes on the platforms, sometimes both. Why? Because even if the transit line wins, the lawsuits cost money and get bad press. Its better to do something that at least makes the riding more difficult to do.
