Yes they are and they do it very well. I rode train 4 to KC in March of this year. It is not true that BNSF does not run anything over the Raton pass line. True it is not a normal route for them but it is still used for the a freight now and again and also car storage, the chance of BNSF closing the line is and will be a rumor and nothing more.
As for keeping the track in top shape? I can tell you for sure it is. The second night we did not slow down below posted track speed(79 mph) except to stop at stations. New Mexico bought the track to stop the BNSF from doing the exact thing you talked about. And according to a New Mexico transportation person I talked to on my return trip in mid March, the state is helping BNSF to keep the track it tip top shape.
