I think this is just more trolling to stir the pot..... by the usual suspects on this issue?
I don't think they have the votes for something as stupid as this. This is the anti-SMART people on the Board squawking and pandering for their extremist's lefto psuedo/phony enviros, and their right wing corporate sponsored train haters. This is a strange alliance of onvenience by those who pander to a noisy clique of nihilistic fanatics, who hate Thomas.
Even if they had the votes, I suspect that the STB is not going there. The environmental has been decided, it is a "Federal" project, so the CEQA stuff appears to be nonsense, and it is interstate commerce, and any challenge to the STB's Federally approved operations order would likely be thrown out. I also suspect that a stay from a State Court over this CEQA nonsense, would be appealed in Federal Court, and overturned, as well. SMART's frivolous legal actions at the State level that cost NWP additional money and/or delay could potentially result in a Federal countersuit, to recover damages and losses to the carrier for restraint of interstate commerce casued by the SMART Board?
The train haters don't care how they waste the taxpayers money, either, as long as they stop Thomas!
