I don't see how an inspection alone will get freight trains running if NCRA has to reach an agreement with the owners of the tracks before they can operate. If anything I would think this ruling would piss off SMART and make negotiations between NCRA and SMART more contentious.

Of course, getting an inspection and passing an inspection are two different animals. I imagine if there is an agreement, SMART will require NCRA to operate around SMART's schedule of reconstruction.
