Not really related, but in the same vein...
Here in suburban Chicago, years ago, a bicyclist was riding along on the shoulder of a local road. He hit a pot hole in the shoulder, fell and suffered injuries.
He sued the County for damages.
He lost his suit.
The Court ruled in favor of the County.
Basically, the Court ruled that highways (ie roads) are for the benefit of automobiles, not bicyclists, and therefore highway maintenance standards are meant for automobiles.
Obviously, this doesn't pertain to the situation in question, but, I would suspect that the results are the same.
