Regardless of what anyone here thinks, whether or not a Brandt or similar unit is a locomotive being used in train service is defined by regulation and the current interpretation of the regulation by the FRA (or Transport Canada), and sometimes by the inspector actually on site.
As I stated above, there is a way a Brandt can be qualified as a locomotive. Didn't WP have a Trackmobile blue carded to try to replace an SW1500 in San Francisco?
The real issue becomes whether the operator is appropriately qualified. The FRA regulations seem to go to great lengths on the requirements for a regular engineer, but not so much for an RCO - even though I contend the RCO needs to have a greater awarness of what the loco is doing. Likewise the Brandt has unique operating characteristics and limitations that the operator has to be familiar with.
