It occurs to me that if you apply Daniel's logic to railroads themselves, there wouldn't be a train operating today...anywhere.

As much as we try to prevent accidents, and as good as our safety equipment has become, there always will be momentary lapses of human judgement and equipment failures that will cause events like this to happen from time to time. It sucks pond scum when difficut or impossible to replace items get caught in the middle...but it happens. That's why businesses and organizations purchase and carry insurance.

We are all fortunate that nobody got hurt or worse as a result of this accident.
