I don't know anything about a lawsuit by PURC (although I know enough about legal processes to know that anyone can file a lawsuit against just about anyone, so the fact that a suit may have been filed proves nothing, one way or another). However, once again, I would suggest that anyone interested in this subject simply look at the materials posted on the STB website for FD 35091 and draw their own conclusions. The website includes opposition filings, not only by UP, but by the United States Department of Transportation and Kaiser Ventures, the owner of the underlying railroad. Obviously, there is something more going on here than what is suggested in the "The Facts" posting .
