In a climate of delay and neglect locals who are opposed to the railroad will work behind the scenes to expropriate pieces of the right of way. This has already happened south of Corte Madera. All it takes is some traffic engineers' recommendation, some well-connected developers pulling strings and a gung-ho-for-better-roads city council and there you have have urban removal.
Before you counter that would be illegal consider to what extent San Rafael has been able legally to mess around with the ROW and how little old Novato along with a politically compliant judge has been able to stymie the whole project. What happens if other anti-rail burgs along the line start imitating Novato, Corte Madera, Larkspur and San Rafael?
