California State Vehicle Code section 12953 specifically prohibits cops from asking for the engineer's (and conductor's) driver's license as ID in grade crossing accidents. IOW, that cop was breaking the law by demanding the E's driver's license. The same is true in virtually all other States, and the concept started in Kentucky.
The reason behind this law is that in asking for the DL and entering the number on a vehicular report of accedent form, which is the incorrect form for reporting grade crossing accidents, the accident goes on the crew's motor vehicle record. More often than not this raises their insurance rates, even though 1) the crew wasn't driving a motor vehicle and 2) wasn't even on a public road.
