If the judge rules against NCRA on all points, which is extremely unlikely, then it will go to appeal, because it would probably cross the line on jurisdictional issues. If he partly rules against them, it would depend, but might also go to appeal, for the same reason.
I think that the case is so overblown and weak that he will not feel that he has jurisdiction to make a significant finding against NCRA, because he knows his decision would be appealed, if he went too far. Judges generally don't like a record of reversals, when their decisions are based on a weak legal basis.
We'll see when it happens. Meanwhile don't get spun by this orchestrated disinformation campaign. The suit itself was clearly brought partially as a tactical stunt, to generate press and controversy, in a political battle.
